Having a criminal record as simple as an arrest can negatively affect your career and employment opportunities for a long time. One single bad choice leading to one arrest can mean a potential employer turning you down. If you want to have a clear criminal record, consider an expungement or sealing of your criminal record. You could have a fresh start.
What Is the Difference Between an Expungement and Sealing?
An expungement allows a person's criminal record to be completely erased of a specific criminal arrest. For example, if you were arrested for a white collar crime, but the charges were dropped, you could expunge that arrest from your record. You cannot expunge a conviction, even if you were placed on probation. The benefit of expungements is that your record is completely off limits to the public, and generally allows you to tell employers you have no criminal history.
Sealing criminal records is different from expungements. Instead of erasing a record, it is sealed from public inquiries. In some situations, albeit limited, your record can be exposed. A withhold of adjudication or not-guilty verdict can be sealed.
Can Your Record Be Expunged or Sealed?
It is important to note that not every criminal charge can be expunged or sealed. In general, someone may only expunge one arrest in his or her lifetime, and only if that case was dismissed or that person was acquitted. A conviction for rape or a felony DUI, for example, is not eligible for expungement. Additionally, you should know that expunging a record does not clear the entire criminal record, but only the arrest for the specific crime.
